.
Summary: Requires DOT to report whether a cell phone was being used by a driver at the time of an accident. This bill also creates a new traffic offense. If a driver is primarily at fault for causing an accident and use of a cell phone contributed to causing the accident, the person is subject to various penalties and may be required to pay restitution for any loss suffered because of the accident. The bill creates a rebuttable presumption that using a cell phone at the time of an accident contributed to the accident.
